Seller Disclosure Contamination Notices Search

Product Overview

The Lotsearch Seller Disclosure - Contamination Notices Search, consolidates records of contamination and environmental notices required for disclosure under the QLD Property Law Regulation 2024. These notices are not included on the QLD Government contaminated land search (EMR/CLR).

  • Designed specifically for the QLD Seller Disclosure framework, this search aligns with Part 3 of the Seller Disclosure Statement (contamination and environmental protection), helping sellers and their representatives identify key records to support their response to related questions.

  • Recognising the time constraints sellers and their agents face during property transactions, this report streamlines the preparation of the Seller Disclosure Statement in an easy to interpret format. By providing records under relevant sections of the Environmental Protection Act 1994, the Search reduces the risk of missing records, prevents costly non-compliance, and safeguards all parties in a transaction.

  • Compliance with the new QLD regulation is mandatory for both residential and commercial sales, with serious implications for:

    • mandatory disclosure requirements under the Property Law Regulation 2024.

    • risk of contract termination if specific disclosure requirements are breached.

    • legal compliance with notices under relevant sections of the Environment Protection Act 1994.

    • transaction delays and inconsistent results due to complex manual sourcing.

Manually sourcing this information is complex and time-consuming, risking non-compliance. This product provides the specific, aggregated records necessary to support sellers and their representatives answer the relevant questions in the disclosure form.

    • Support lawyers/conveyancers to ensure legal compliance.

    • Streamline workflows for Seller Disclosure preparation.

    • Confidently advise sellers on specific environmental notices and orders.

    • Protect clients and reduce risk of non-compliance.

    • Enhance reputation and build client trust.

  • Mandatory Disclosure

The Property Law Regulation 2024 (QLD) requires sellers to provide a mandatory and comprehensive "Seller Disclosure Statement" before contract signing, effective from August 2025.

    Specific Notice Compliance

Disclosure must specifically cover notices and orders under sections 347(2), 369C(2), and 408(2) of the Environmental Protection Act 1994. These notices are not included on the standard DETSI contaminated land search (EMR/CLR).

    Termination Risk

Failure to comply with these mandatory disclosure requirements can give the buyer the clear right to terminate the contract before settlement.

    • Designed specifically to help sellers and their representatives meet legal disclosure requirements under the new QLD framework.

    • Aggregates data from relevant environmental registers that are excluded from the QLD EMR/CLR search.

    • Provides links to the downloadable notice documents required for disclosure.

    • Saves time and builds efficiency into the workflow of real estate agents and conveyancers preparing disclosure documents.

    • Supports legal compliance and reduces the risk of non-compliance and contract termination.
