Seller Disclosure - Heritage Search (QLD)

Product Overview

The Lotsearch Seller Disclosure - Heritage Search enables sellers and their representatives to meet their legal disclosure obligations under the new QLD Seller Disclosure framework by compiling known heritage information relevant to the property, searching both the Queensland Heritage Register and the World Heritage List.

  • Designed specifically for the QLD Seller Disclosure framework, this search aligns with the Part 3 – Land use, planning and environment (Heritage) section of the Seller Disclosure Statement, helping sellers and their representatives identify key records to support their response to the relevant question.

  • Recognising the time constraints sellers and their agents face during property transactions, this report streamlines the preparation of the Seller Disclosure Statement in an easy-to-interpret format. By providing records of heritage listings and applications under the Queensland Heritage Act 1992 and sites on the World Heritage List under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act), the Search reduces the risk of missing records, prevents costly non-compliance, and safeguards all parties in a transaction.

  • Compliance with the new QLD regulation is mandatory for both residential and commercial sales, with serious implications for:

    • mandatory disclosure requirements under the Property Law Regulation 2024.

    • risk of contract termination if specific disclosure requirements are breached.

    • legal compliance with heritage listings under the Queensland Heritage Act 1992 and the EPBC Act.

    • transaction delays and inconsistent results due to manual sourcing.

Manually sourcing this information is complex and time-consuming, risking non-compliance. This product provides the specific, aggregated records necessary to support sellers and their representatives answer the relevant questions in the disclosure form.

    • Support lawyers/conveyancers to ensure legal compliance.

    • Streamline workflows for Seller Disclosure preparation.

    • Confidently advise sellers on specific heritage designations.

    • Protect clients and reduce risk of non-compliance.

    • Enhance reputation and build client trust.

  • Mandatory Disclosure

The Property Law Regulation 2024 (QLD) requires sellers to provide a mandatory and comprehensive "Seller Disclosure Statement" before contract signing, effective from August 2025.

    Specific Heritage Compliance

Disclosure must specifically cover whether the property is included in the World Heritage List under the EPBC Act or affected by the Queensland Heritage Act 1992 – meaning a property is included on the Queensland Heritage Register (QHR), is subject to an application to include on or remove from the QHR, or is an excluded place from entry on the QHR. Whether the property is included in the World Heritage List is not covered by a Certificate of Affect.

    Termination Risk

Failure to comply with these mandatory disclosure requirements can give the buyer the clear right to terminate the contract before settlement.

    • Designed specifically to help sellers and their representatives meet legal disclosure requirements under the new QLD framework.

    • Aggregates data from relevant government registers, including the World Heritage List which is not included in the Certificate of Affect.

    • Provides links to further details of properties on the Queensland Heritage Register.

    • Saves time and builds efficiency into the workflow of real estate agents and conveyancers preparing disclosure documents.

    • Supports legal compliance and reduces the risk of non-compliance and contract termination.

    • Builds client trust and confidence by demonstrating expertise specific to the QLD disclosure requirements.
